Terms and Conditions of Use

These Terms and Conditions (hereinafter, “Terms”) govern the access to and the use of the website www.jesolobeach.com(the “Site”), operated by SUBLIME Ventures di Riccardo Ongaro, VAT no. 04840530275, with registered office at Via Sant’Agostino 36, 31100 Treviso (TV), Italia. Accessing the Site implies full acceptance of these Terms.

1. Subject of the service

The Site is an editorial information portal dedicated to the locality of Jesolo (VE). Services currently offered include, by way of example: publication of travel guides, events calendar, listings of businesses and accommodation facilities, weather forecasts, interactive beach map, and contact forms. The Site also offers commercial entities lead-generation services and the publication of sponsored content.

2. Informational nature of the Site — no direct offer to consumers

The Data Controller does not sell goods or services to the end consumer through the Site. The information published is of an editorial and informational nature: any offers, prices, availability or opening hours relating to third-party facilities are indicative and must be verified directly with the relevant parties before making any decisions.

3. Sponsored content and partnerships

The Site hosts paid advertising content and sponsorships. Such content is always clearly identifiedwith the label “Sponsored”, “Partner” or equivalent, in compliance with EU Directive 2005/29 on unfair commercial practices and with the Italian Consumer Code.

The opinions, offers and features described within sponsored content are the sole responsibility of the advertiser. The Data Controller acts merely as an editorial intermediary and does not guarantee the accuracy or truthfulness of such content.

4. Lead-generation service

Through certain forms (e.g. “House of the Week”) you may request to be contacted by a commercial partner (e.g. a real-estate agency). In such cases:

• the Site acts as a mere intermediary in transmitting the request;
• the contractual or pre-contractual relationship is established directly between you and the partner;
• the Data Controller is not a party to that relationship and is not responsible for the partner's conduct;
• your data are transmitted only after your explicit consent (see Privacy Policy).

5. Intellectual property

All original content of the Site (text, graphics, layout, logo, source code, illustrations of the beach map) is the property of the Data Controller or of the respective authors and is protected by Italian Law 633/1941 (copyright) and by applicable European legislation.

Trademarks, logos, trade names and images relating to partners, businesses or third-party events are the property of their respective owners and are used for informational purposes.

Reproduction, even partial, of the content of the Site without prior written authorisation is prohibited. The use of extracts for purposes of criticism, review or reporting is permitted within the limits of Art. 70 L. 633/1941.

6. Prohibited conduct

You undertake not to:

• use the Site for unlawful, fraudulent or harmful purposes against third parties;
• attempt to access without authorisation restricted areas, databases or systems of the Site;
• carry out mass scraping, reverse engineering or operations that undermine the stability of the service;
• submit through the forms defamatory, offensive, false or unauthorised advertising content (spam);
• impersonate third parties or provide personal data of others without their consent.

7. Links to external sites

The Site may contain links to third-party websites. Such links are provided as an additional service to the user: the Data Controller does not control the content of external sites and disclaims any responsibility for their accuracy, security or legal compliance.

8. Limitation of liability

To the extent permitted by Italian law, the Data Controller shall not be liable for indirect or consequential damages, loss of profit, loss of opportunity or reputational damage arising from the use of the Site. The total liability of the Data Controller towards you for any cause relating to the Site shall not, in any case, exceed the amount of EUR 100,00.

9. Force majeure

The Data Controller is not liable for delays or non-performance due to causes beyond its control (e.g. malfunctions of cloud providers, cyberattacks, official orders, natural disasters).

10. Changes to the Terms

The Data Controller may modify these Terms at any time for technical, legal or service reasons. Changes take effect upon publication on the Site. The date of the latest update is indicated at the top of the document. Continued use of the Site after publication constitutes acceptance of the changes.

11. Applicable law and jurisdiction

These Terms are governed by Italian law. For any dispute, the Court of Venice shall have exclusive jurisdiction, subject to the application of the mandatory consumer jurisdiction (Art. 66-bis of the Italian Consumer Code) where applicable.
